Supreme Court Overturns Biden OSHA Mandate

Washington, D.C. –  The Supreme Court released their decision in the case of the National Federation of Independent Business (NFIB) v. the Occupational Safety and Health Administration (OSHA).

The question before the Court was the constitutionality of Biden’s employer vaccine mandate, which required businesses with 100 or more employees to require COVID-19 vaccination. 

In a 6-3 decision, the Supreme Court ruled in favor of NFIB, striking down the OSHA vaccine mandate. This is a huge blow to the Biden administrations’ vaccine mandate agenda. The OSHA mandate affected more than 84 million Americans. Now, these Americans no longer have to face the decision between losing their job or getting the COVID-19 vaccine.

The majority was made up of Justice Gorsuch, Justice Alito, Justice Thomas, Justice Barrett, Justice Kavanaugh, and Chief Justice Roberts. The dissenters were made up of liberal Justices Kagan, Breyer, and Sotomayor.

Justice Gorsuch, in his concurring opinion, wrote: 

“If administrative agencies (such as OSHA) seek to regulate the daily lives and liberties of millions of Americans. . . they must at least be able to trace that power to a clear grant of authority from Congress.”

Gorsuch pointed out that over the course of the pandemic, Congress has passed a series of major bills to address COVID-19, but none of them authorized OSHA to create a regulation for anyone near this scope.

But the most striking portion of Gorsuch’s opinion came at the close, which reads: 

“The question before us is not how to respond to the pandemic, but who holds the power to do so. The answer is clear: Under the law as it stands today, that power rests with the States and Congress, not OSHA. In saying this much, we do not impugn the intentions behind the agency’s mandate. Instead, we only discharge our duty to enforce the law’s demands when it comes to the question who may govern the lives of 84 million Americans. Respecting those demands may be trying in times of stress. But if this Court were to abide them only in more tranquil conditions, declarations of emergencies would never end and the liberties our Constitution’s separation of powers seeks to preserve would amount to little.”

  1. Yes, at least they did the correct thing in this action …..BUT…..what about the members of our MILITARY…..that are being kicked out? How did they miss them. Also the other part of the suit about private companies still being able to do the jab? Seems to me that they only did half of the job that needed to be done which should have been corrected …..yesterday.

  2. It’s about time that dictators Biden and Fauci were slapped down. America is a constitutional republic not a dictatorship of leftist elites. It doesn’t matter what Pelosi and her trained stooge Schumer want, American citizens have a say in our government and they are supposed to work for us.

  4. The U S Supreme Court makes too much sense for liberals to comprehend. they should have said “you are not gods so stop trying to act like them”.

  5. Of course the decision was the only correct one, but yes, what about the Military – those sworn to protect our country – and it makes you wonder why the vote wasn’t 9-0. Even at 6-3, when it comes to clear constitutionality, it’s too close for comfort.
