Washington, D.C. — President Joe Biden’s administration is considering an unconstitutional interstate travel ban in response to increasing COVID-19 cases.
The ban would not be on everyone, of course. Instead, the ban would target the unvaccinated population utilizing a “vaccine passport” scheme.
The AP writes:
“…while more severe measures — such as mandating vaccines for interstate travel or changing how the federal government reimburses treatment for those who are unvaccinated and become ill with COVID-19 — have been discussed, the administration worried that they would be too polarizing for the moment.”
“That’s not to say they won’t be implemented in the future, as public opinion continues to shift toward requiring vaccinations as a means to restore normalcy.”
There is one small problem with the Biden administration’s plan.
Freedom of movement is a fundamental human right that is backed by the U.S. Constitution and judicial precedence.
While there has not been a major challenge to the U.S. citizen’s right to interstate travel, there are instances that back it.
In 1941, California’s ban on the “Okies” traveling to the state was found unconstitutional by the U.S. Supreme Court.
In a 1999 case, Justice John Paul Stevens wrote the majority opinion outlining three separate aspects of the right to travel between states that the U.S. Constitution protects.
(1) the right to enter one state and leave another (an inherent right with historical support from the Articles of Confederation),

(2) the right to be treated as a welcome visitor rather than a hostile stranger (protected by the “Privileges and Immunities” clause in Article IV, § 2), and
(3) (for those who become permanent residents of a state) the right to be treated equally to native-born citizens (this is protected by the 14th Amendment’s Privileges or Immunities Clause; citing the majority opinion in the Slaughter-House Cases, Justice Stevens said, “the Privileges or Immunities Clause of the Fourteenth Amendment . . . has always been common ground that this Clause protects the third component of the right to travel.”).
Any attempt by the Biden administration to circumvent the constitutional right of U.S. citizens to travel between states would likely be found unconstitutional.
Only time will tell if the Biden administration is willing to cross the constitutional rights of U.S. citizens in this instance.

Why can’t we just be friends without considering color/race? When I grew up in Ohio we had no race problems that I was aware of. In my Catholic school we had one black family and they were treated equally with no real problem. NO one ever made any remarks about race/color we just all got along as friends.
