[Updated] The House of Representatives passed H.R. 8 and H.R. 1446 Thursday morning.
Washington, D.C. — The House of Representatives is scheduled to vote on two gun control bills Thursday, both dealing with background checks.
The first bill is H.R. 8, commonly referred to as “Universal Background Checks,” which creates criminal penalties for the private sale of firearms.
“Universal Background Check (UBC)” legislation has been at the top of the Democrat wish list on guns for decades now. Democrats have more momentum on this issue than they have had in years past. With 131 cosponsors in the House (3 being Republican), control of the Senate, and Joe Biden in the White House, the push for UBCs will be an aggressive effort.
The Senate is also working on the same issue with a companion bill, which has 46 cosponsors.
Opponents of UBCs are quick to point out that the National Instant Criminal Background Check System (NICS), which processes background checks, is a deeply flawed system that often denies lawful gun owners the ability to purchase firearms.
According to a study from Crime Prevention Research Center’s John Lott, upwards of 95% of NICS denials are false positives. What’s more, the Department of Justice rarely, if ever, pursues ineligible persons who illegally attempt to purchase a firearm.
Pro-gun group, the National Association for Gun Rights (NAGR), is also making the argument that NICS functions as a gun registration system, given that paper records are sent to the FBI with the gun purchaser’s name and personal information, along with the gun’s serial number.
NAGR argues that if H.R. 8 becomes law, it will essentially serve as a universal gun registration list.
Democrats often point to a survey saying that 86% of Americans support UBC legislation, but the results of this survey are contested given bias in the line of questioning.
Along with H.R. 8, the House will also be voting on H.R. 1446, the “Background Check Enhancement Act.”
H.R. 1446 closes what Democrats often call the “Charleston Loophole.” Under current law, if a background check on a firearm purchase cannot be immediately cleared, the FBI has three business days to certify that someone is ineligible to own a firearm. If the FBI cannot prove ineligibility in that timeframe, the gun sale may be processed. The FBI then has thirty days to complete their process and correct their wrong, if needed.
If H.R. 1446 becomes law, the three-day time limit becomes a ten-day minimum, meaning lawful gun purchases could potentially be held up indefinitely.
The House is scheduled to vote on both bills tomorrow morning. Both bills are likely to pass the House, but the Senate will be a trickier hurdle for Democrats, who will have to deal with a 60 vote threshold.
