Colorado Gov. Jared Polis Attempted to Restrict Religious Liberty and Failed

Denver, CO — Colorado Governor Jared Polis attempted to restrict religious liberty and failed. Supreme Court Justice Neil Gorsuch penned the opinion.

Weeks after the Supreme Court ruled against the state of New York in the case of Catholic Diocese of Brooklyn vs. Cuomo for infringing on the right of individuals to practice their religion as part of “COVID protections,” Justice Gorsuch wrote an opinion today in the case of High Plains Harvest Church vs. Jared Polis, Governor of Colorado.

This opinion reaffirmed the decision from New York that Governors cannot place artificial limits on houses of worship, who in both cases did their best to mitigate damage from COVID-19 while attempting to remain open.

The opinion denied a request for an injunction against Governor Polis, who rescinded the order after deliberation with the Attorney General, who advised the practice be ended after the precedent established in the decision against Andrew Cuomo.

Gorsuch wrote in his opinion that the question at hand had been resolved while issuing his understanding that Governor Polis never attempt such an order again. It also said that the Cuomo decision should be enforced in the Circuit Court, which is directed to resolve the case’s finer details.

This is a huge win for religious liberty in a state that is perceived as hostile to people of faith after the State of Colorado lost a 7-2 decision in the Supreme Court two years ago.

That lawsuit emerged from prolonged harassment, fines, and fees against Jack Phillips and his business Masterpiece Cakeshop. Phillips refused to decorate cakes for homosexual weddings but would otherwise sell them goods.

On examination of the facts, the Supreme Court criticized the State of Colorado for their noted anti-Christian zealotry that was uncovered in the court proceedings.

Today’s ruling is a great relief to parishioners of all faith that they may proceed in celebrating the holidays without fear of government harassment.
