ATF Will not Wait for Biden to Push Gun Control

Who knew it took such an elaborate building for bureaucrats to infringe on constitutional rights?

Washington D.C. — The Bureau of Alcohol, Tobacco, and Firearms (ATF) will not wait for President-elect Joe Biden to push gun control on law-abiding American citizens.

Today, the ATF issued a ruling instituting a ban on pistol braces, effectively banning AR and AK platform pistols.

The notice comes as a Christmas surprise for the millions of gun owners who own these types of accessories. If the ban goes forward, these gun owners would become instant criminals in the eyes of the ATF.

The ATF is issuing the ruling based on the National Firearms Act of 1934. The law gives the ATF authority to regulate accessories. Notably, the law has been used to regulate suppressors. Now the ATF has unilaterally decided that they want to give pistol braces a similar treatment.

Pistol brace owners will be forced to register their firearms and pay a substantial fee in order to keep their property. The enforcement of this new rule is unclear, though. The ATF is planning on giving gun owners the following options according to their release today:

“Registering the firearm in compliance with the NFA, permanently removing the stabilizing brace from the firearm and disposing of it, replacing the barrel of the firearm (16” or greater for a rifle, or 18” or greater for a shotgun), surrendering the firearm to ATF, or destroying the firearm.”

The ATF is accepting public comment for the mandated 14 days, which puts the end date requirement on December 31st, New Year’s Eve. The ATF has no obligation to change their mind or listen to public input, but gun rights activists will likely flood the comments page with their input. Those who desire to make a comment will be asked to provide their full legal name and address.

The announcement comes at a convenient time for the ATF, given Attorney General Bill Barr’s departure and the holiday season. The ATF will benefit from the timing, as many law-abiding gun owners may be completely unaware that they will be turned into criminals overnight without notice.

President Trump can put a stop to the ATF action if he chooses, but the White House has not made any indication to that effect yet. In 2018, President Trump’s ATF banned bump stocks following the Las Vegas shooting, so it would not be out of character for the President to let this new gun ban go through.
