
Gunnison, CO – Are Democrats banning Republicans from their homes? We wanted to do an article on this back in April, but it got bumped for another COVID-19 story. However, a Colorado Daily cover this…so we will seize the opportunity. Governments are forcing people from their homes or telling them not to use them.
Many of you may think this is a hook and a little misleading, but if you own the home, you should be able to use it, whether it is your “Second Home” or not. Gunnison County is home to the towns of Gunnison, and Crested Butte was telling people who have homes there not to come or were there during the COVID scare, to leave. Yes, literally leave their homes.
Are Democrats banning Republicans from their homes?
As the Colorado Sun reports:
“an April 5 health order broke that alignment and riled some of the 4,400 second-home owners in the county that has a full-time population around 17,000. That health order demanded all part-time residents leave immediately and promised a $5,000 fine and up to 18 months in jail for anyone who stayed. “

If you do the math, that’s about 25 percent of the population. The population was told to leave, be jailed or fined. You may be thinking these are rich people with second homes; however, real estate in Gunnison County is affordable, and many middle-class people invested their savings in cheap property decades ago with plans to retire or have a retreat. They paid for the property and own it!
This caught the attention of the Texas Attorney General in April, and he opined in a letter:
On April 9, Texas Attorney General Ken Paxton wrote a letter to Reynolds and the county’s health department, saying the “patent discrimination” against nonresident homeowners “runs afoul of the United States Constitution.”…”There is no indication that nonresident homeowners, as a whole, are more susceptible to COVID-19 based on age or other health criteria, or that those nonresidents will pose any greater strain on local resources than residents,” reads the letter, which asked Reynolds to modify her order “to protect the rights of nonresident homeowners.”

There are many other legal issues here like one family claimed in a lawsuit (now dropped) that this was “Regulatory Taking”. In layman’s terms, “Regulatory Taking” means you are denied your 5th Amendment Rights with the government taking your property without just compensation.
This issue is not limited to mountain towns in Colorado. This has been an issue in New York, in the United Kingdom, Norway, and Michigan. In Michigan, there is some ongoing litigation. As Bloomberg reports:
In Michigan, a lawyer and a landscaping business owner filed a joint court challenge Wednesday to Governor Gretchen Whitmer’s ban on travel to second homes, saying that keeping them from their cottages does nothing to prevent the spread of coronavirus. The measures “lack any rational basis, are arbitrary, capricious and vague,” and “have no real or substantial relationship” to protecting public health, according to the complaint. The complaints continue, saying that Democrat Governor Gretchen “Whitmer’s restrictions undermine their “fundamental” liberty and violate their rights to due process and equal protection. A third plaintiff, Robert Muise, claims Whitmer’s order violates his First Amendment rights by blocking him from associating with family members.”

The common theme here is politicians in New York, New Jersey, Michigan, and Gunnison County are all Democrats. If you read the article on Gunnison, they affected homeowners have formed a Political Committee to help a Republican and a right-leaning Unaffiliated candidate take out these left Democrats in the next election. The lawsuit filed in Michigan is supported by American Freedom Law Center, a self-described Judeo-Christian law firm that “fights for faith and freedom.”.
Are Democrats banning Republicans from their homes? Yes, folks, this is a fight of the Right versus the Left. The Left is about controlling our lives while the Right (in general) is about protecting our freedoms and liberties. There is a war going on, time to wake up and fight!
